We provide a calendar-based gift recommendation and delivery service ("Service") that helps users send gifts to their contacts based on calendar events and special occasions.
3.1 Registration
- You must provide accurate, current, and complete information during registration
- You are responsible for maintaining the confidentiality of your account credentials
- You must be at least 18 years old to use our Service
3.2 Calendar Integration
- You grant us permission to access and sync with your designated calendar(s)
- We will only access calendar data necessary for providing our Service
- You are responsible for maintaining accurate calendar information
4.1 Order Processing
- All gift orders are subject to availability
- Prices are subject to change without notice
- We reserve the right to refuse any order at our discretion
4.2 Delivery
- Delivery times are estimates and not guaranteed
- You are responsible for providing accurate delivery information
- We are not responsible for gifts that cannot be delivered due to incorrect information
- Additional charges may apply for expedited shipping or special handling
5.1 Pricing
- All prices are in SGD and include applicable taxes
- Shipping costs are calculated at checkout
- Subscription fees, if any, will be billed according to the plan selected
5.2 Payment Processing
- We use secure third-party payment processors
- You agree to pay all charges at the prices then in effect
- You authorize us to charge your chosen payment method
6.1 Order Cancellation
- Orders can be cancelled up to 24 hours before scheduled delivery
- Custom or personalized items may not be eligible for cancellation
- Cancellation fees may apply
6.2 Refunds
- Refund eligibility is determined on a case-by-case basis
- Processing times for refunds may vary
- Shipping costs are generally non-refundable

- User-generated content remains the property of the user
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount paid for the specific gift order in question
- We are not responsible for delays or failures beyond our reasonable control
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our Service constitutes acceptance of any modifications.
We may terminate or suspend your account and access to our Service at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.

Vendor Terms and Conditions
By registering as a vendor on Gift Kakis ("Platform"), you agree to be bound by these Terms and Conditions ("Terms"). Please read them carefully before proceeding with registration.
2.1 Requirements
- Be a legally registered business entity or individual seller (including home-based businesses)
- Provide accurate and complete business information
- Maintain updated contact and payment information
- Be authorized to sell the products you list
- Submit relevant documents based on category (ACRA Registration, Food Hygiene Certification, NRIC Verification)
2.2 Home-Based Businesses
Home-based vendors will be clearly tagged as "Home-Based" on their product listings for transparency.
2.3 Account Security
You are responsible for providing accurate information and maintaining the confidentiality of your account credentials.
2.4 Account Usage
- Vendors may not share their account with others or use another user's account without permission
- Vendors are solely responsible for all activities that occur under their account
3.1 Listing Requirements
- Provide accurate descriptions of all products
- Update product availability in real-time
- Set fair and transparent pricing
- Include clear images of products
- Specify all relevant gift details and restrictions
3.2 Prohibited Items
- Illegal or counterfeit goods
- Weapons, explosives, and hazardous materials
- Tobacco products, controlled drugs, and alcohol
- Adult content and explicit materials
- Products that violate intellectual property rights
Gift Kakis reserves the right to remove listings that violate platform policies.
4.1 Vendor Commitments
- Honor all confirmed orders and ensure timely fulfillment
- Maintain sufficient inventory for listed products
- Meet scheduled delivery timelines
- Provide tracking information when applicable
- Respond to orders as soon as possible, within 24 hours
Vendors who fail to respond to orders in time will receive a warning from Gift Kakis.
4.2 Order Notification Process
- When an order is placed, vendors will receive order details via WhatsApp, including an accept/reject button
- Vendors must confirm or reject the order within the required response time
4.3 Delivery Policy
- Gift Kakis handles and bears the cost of delivery
- Vendors are not responsible for delivery logistics
- If Gift Kakis expects late delivery due to unforeseen circumstances, both the vendor and customer will be updated
4.4 Delivery Issues
- In the event of delivery delays or damages caused by our delivery service, Gift Kakis will take full responsibility
- If vendors fail to fulfill an order that is not the fault of Gift Kakis, we will claim the money back from the vendor after issuing a refund to the customer
5.1 Platform Fees
- Commission per successful transaction: 10%
- Payment processing fees: 2% (depending on payment method)
- Vendors retain 88% of the sale price
5.2 Payment Terms
- No minimum payout threshold
- Payouts are processed almost immediately after deducting commission and transaction fees
- Vendors are responsible for providing accurate payment information
- All applicable taxes and compliance costs are the vendor's responsibility
Vendors must comply with all applicable Singapore laws, including but not limited to:
- Sale of Goods Act – Vendors must ensure that products sold are of satisfactory quality, fit for purpose, and match their description
- Lemon Law – Vendors must be aware of their obligations to provide remedies if products sold are defective
- Tax Obligations – Vendors are solely responsible for declaring and paying any applicable taxes on their sales
7.1 Vendor Responsibilities for Order Cancellations
- Refunds are only available during the processing stage of an order (before vendors confirm)
- Once all vendors confirm an order, users cannot request a refund
7.2 Order Rejection
Gift Kakis reserves the right to reject orders if users enter invalid details, such as incorrect addresses or phone numbers.
7.3 Platform Rights
Gift Kakis may:
- Suspend or terminate accounts violating these terms
- Remove listings that fail to meet platform requirements
- Hold payments pending investigations of policy violations
Vendors may terminate their account with 15 days written notice, subject to completing all pending orders.
8.1 Vendor Responsibilities
- Vendors must maintain appropriate business insurance where applicable
- Vendors must indemnify Gift Kakis against claims related to their products and services
- Vendors accept full responsibility for product quality and safety
9.1 Vendor Obligations
- Vendors must handle customer data in compliance with Singapore privacy laws
- Vendors may only use customer data for order fulfillment purposes
- Vendors must maintain the confidentiality of platform data and are prohibited from sharing customer information with third parties
10.1 Terms Modifications
- 15 days notice will be provided for minor changes
- 15 days notice will be provided for material changes
- Continued use constitutes acceptance of modified terms
These terms are governed by the laws of Singapore, without regard to conflicts of law principles.
